Opt-Out Preference Signals

Some web browsers or devices offer settings where you may pre-set a signal to websites that you do not want to have your online activity and behavior tracked, Sold, Shared, or otherwise used for targeted advertising purposes. We recognize the opt-out preference signals that we are required to recognize for compliance with applicable law. Where required by U.S. Privacy Laws, we treat the opt-out preference signals we are required to comply with as a valid request to opt-out of Sale, Sharing, and processing for purposes of targeted advertising, as applicable, for the browser or device through which the signal is sent and any consumer profile we have associated with that browser or device, including pseudonymous profiles. Further, if we know the identity of the consumer from the opt-out preference signal, we will also treat the opt-out preference signal as a valid request to opt out of Sale and Sharing for such consumer. Consumers may use opt-out preference signals by downloading or otherwise activating them for use on supported browsers and setting them to send opt-out preference signals to websites they visit. Please note, however, that our sites are not currently configured to recognize the “Do Not Track” signal.

Non-Discrimination

We will not discriminate against you for exercising your data subject rights. For example, we will not deny goods or services to you, charge you different prices or rates, or provide a different level of quality for products or services as a result of you exercising your data subject rights.

Verification of Data Subject Requests & Appeals

As permitted or required by applicable privacy laws, we may ask you to provide information that will enable us to verify your identity in order to comply with your data subject request. In particular, when a California Customer or Consumer, or a Colorado Consumer, authorizes an agent to make a request on their behalf, we may require the agent to provide proof of signed permission from the Customer or Consumer to submit the request, or we may require the Customer or Consumer to verify their own identity to us or confirm with us that they provided the agent with permission to submit the request. In some instances, we may decline to honor your request if an exception applies under applicable privacy laws. We will respond to your request consistent with applicable privacy laws.

To appeal our decision on your data subject requests, you may contact us by completing our Web Form. Please enclose a copy of or otherwise specifically reference our decision on your data subject request, so that we may adequately address your appeal. We will respond to your appeal in accordance with applicable law.

Disclosure for California Residents

  • Direct Marketing. California Civil Code § 1798.83 permits California residents to annually request certain information regarding our disclosure of Personal Information to other entities for their direct marketing purposes in the preceding calendar year. We do not disclose Personal Information, as defined by California Civil Code § 1798.83, to Third Parties for their direct marketing purposes.
  • Financial Incentives for California Residents. We will describe such programs to you if and when we offer them to you. We offer pet owners the opportunity to participate in our Petcare Rewards Program (the “Program”), which may provide benefits, including earning reward points for use at veterinary practices, to those who choose to join (our “members”). Those benefits are described along with other material terms and conditions here.

Our collection of members’ Personal Information (including name, email address, product purchase details and other Personal Information as described above under “Types of Personal Information We Collect”) allows us to operate the Program and provide membership benefits. We use the Personal Information of Program members to both award and redeem points. Otherwise, the types of Personal Information that we collect from Program members are generally similar to the types of Personal Information that we collect from individuals who are not Program members. The amount of Personal Information that we collect from a member or non-member may vary and is dependent on the level of interactions and engagement that the member or non-member has with us.

We seek to ensure that both members and non-members have a positive and beneficial experience when seeking the best products and services for their pets. For this reason, we may collect information from both members and non-members related to their personal preferences in order to provide personalized services, as described above under “Purposes for Collecting, Processing, & Disclosing Personal Information.” We “sell” and “share,” as those terms are defined under the CCPA, Personal Information of both Program members and non-members to third parties for the purposes of personalizing online advertising content, as described in this Disclosure.

We estimate the value of a member’s Personal Information to us, solely for purposes of the CCPA and pursuant to the valuation options mandated by the CCPA regulations, to be reasonably related to the value of the benefits Program members obtain through participating in the Program. We have based this good faith estimate on the value that arises from our commercial relationships, such as with veterinarians, the costs and expenses we incur in offering the Program, the types of rewards offered, and the collection, use and retention of the Personal Information of consumers who have voluntarily signed up and chosen to remain in the Program. The value of Program benefits to members varies significantly as individual members take advantage of Program benefits to varying degrees.

You may join the Program on our website. Members who are California residents may exercise their CCPA rights, including the rights to know, correct, to request deletion, and to opt out of the sale or sharing of Personal Information, without any effect on their membership status or eligibility to receive rewards, and Program members who exercise their privacy rights under the CCPA receive the same benefits as members who do not. A member may also choose not to receive marketing communications or offers at any time without any effect on their membership status or eligibility to receive Program benefits. You may cancel your membership in the Program at any time by notifying us at using the Contact Us form or by phone at 855-749-7274.

Disclosure for Nevada Residents

To the extent we collect Personal Information that identifies you through an online website or service among the categories of Personal Information listed above, we do not sell that Personal Information for monetary consideration.

Our Legal Bases for Using Your Personal Information

We will only process your Personal Information when we have a valid legal basis to do so. Most commonly, we process Personal Information in the following circumstances:

  • Where we need to comply with a legal or regulatory obligation;
  • Where we need to perform the contract, we are about to enter into or have entered into with you;
  • Where you consent;
  • Where it is necessary for our legitimate interests (i.e. we have a business or commercial reason for using your information) and your interests and your fundamental rights do not override those interests. Our legitimate interests may include:
    • Providing our products and services to you;
    • Marketing our products and service offerings;
    • Communicating with you and providing high-quality customer service;
    • Developing and improving the efficiency and security of our systems and infrastructure; and
    • Expanding or developing our business or ensuring its continued success.

We may rely on more than one legal basis for processing your Personal Information, depending on the specific processing purposes for which we are using your Personal Information.

We will only use your Personal Information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your Personal Information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

You are not required to provide your Personal Information to us. However, in some contexts, we may be unable to provide our Services to you if you decide not to provide your information to us.

Your Rights

Subject to any local or national law exceptions, if your Personal Information is processed by Zoetis, you may have certain rights, which may go by different names in your country of residence.

  • Deletion. In certain circumstances, you have the right to request that we delete Personal Information that we process about you.
  • Restriction. You have the right to request that we restrict our processing of your Personal Information where: (a) you believe such information to be inaccurate, (b) our processing is unlawful but you oppose the deletion of your Personal Information, (c) we no longer need to process such information for a particular purpose, but where we are not able to delete the data due to a legal or other obligation or because we require the information in connection with legal claims, or (d) you have objected to the processing of your Personal Information.
  • Portability. You have the right to request that we transmit the Personal Information we hold in respect of you to another data controller, where this is (a) Personal Information which you have provided to us, (b) the processing is by automated means, and (c) we are processing that information on the basis of your consent or in order to perform our obligations under a contract to you.
  • Objection. Where the legal justification for our processing of your Personal Information is our legitimate interest, you have the right to object to such processing on grounds relating to your particular situation. We will abide by your request unless we have compelling legitimate grounds for the processing which override your interests and rights, or if we need to continue to process the data for the establishment, exercise, or defense of a legal claim.
  • Withdrawing Consent. If we rely on your consent to process your Personal Information, you have the right to withdraw your consent at any time. This includes cases where you wish to opt out from marketing messages that you receive from us.
  • Making a Complaint. You may make a complaint at any time with the national data protection authority in the country where you are based. You may contact us by completing our Web Form at any time to exercise any of the rights which apply to you. You will generally not have to pay a fee to access your Personal Information (or to exercise any of the other rights listed above). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we may refuse to comply with your request in these circumstances. We may need to request specific information about you to help us confirm your identity and ensure your right to access your Personal Information (or to exercise any of your other rights).

Cross-Border Data Transfers

We may transfer Personal Information to other countries, including those outside the EEA or the UK, which may have different data protection regimes that offer fewer protections for Personal Information.

When transferring Personal Information, we take care to comply with applicable law, including data localization laws. For example, in contexts where we transfer Personal Information collected in the EEA or UK to a country for which the European Commission or UK authorities have not granted an adequacy determination, we generally rely on standard contractual clauses (EU SCCs) adopted by the European Commission and, as applicable, the UK addendum to the EU SCCs adopted by the UK Information Commissioner’s Office, in conjunction with appropriate technical and organizational measures. A copy of these standard contractual clauses can be requested by completing our Web Form. We may also rely on other mechanisms available under applicable law to facilitate such transfers of Personal Information.

Our Legal Bases for Using your Personal Information

We will only process your Personal Information for the purposes outlined in the “Purposes for Collecting, Processing, & Disclosing Personal Information ” section of this Privacy Notice. The legal basis for our processing will primarily include:

Cross-Border Transfers

As we are a global company, your Personal Information may be transferred to and processed in countries outside the PRC, including the United States. We will ensure that such cross-border transfers comply with the requirements of the PIPL. Currently, we primarily rely on the Standard Contractual Clauses (“SCCs”) issued by the Cyberspace Administration of China with the overseas recipients to facilitate these transfers. You have the right to obtain a copy of these SCCs by contacting us.

We ensure that cross-border data transfers comply with PRC data localization requirements (where applicable) and do not transfer any Personal Information that is prohibited from being exported under PRC laws and regulations.
